The protection of your personal data is very important to us. This is to inform you about the type and scope of personal data we collect when you visit our web pages or social media sites. The following Data Protection Declaration applies to this website and 4K5's Facebook, Instagram and LinkedIn pages.

UMAREX GmbH & Co. KG takes the protection of your personal data very seriously. We want you to know when we store which data and how we use these data. As a company under private law, we are subject to the provisions of the European General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) and the German Telecommunications and Telemedia Data Protection Act (TTDSG). We collect and use your personal data exclusively in accordance with the provisions of the data protection law of the Federal Republic of Germany. 1. General Issues

In most cases, you can use our website without giving any personal information. Wherever personal data is requested on our pages (e. g. name, address, or email addresses), this will be on a voluntary basis. Without your consent, this data will not be disclosed to others.

4. Personal data

Personal data are information that can be used to establish personal or factual circumstances about you (e.g. name, address, telephone number, date of birth or email address). Information for which we can establish no reference to your person (or only with disproportionate expense or effort), e.g. through the anonymisation of the information, is not personal data.

Personal information such as your name, address, telephone number or email address are only collected if you provide us with such information voluntarily. In such cases we collect personal data exclusively in accordance with the applicable data protection regulations.

5. Personal data in the contact form

On our website we offer you the opportunity to contact us by e-mail and/or via a contact form. Your personal data entered in the contact form (mandatory fields: Subject, title, surname, first name, e-mail, customer type (end user, dealer, press representative, authority/public institution), country; optional data: Phone, address) and your message will only be sent to us, stored and processed as encrypted e-mail (TLS-encrypted) for the intended purpose of processing your contact.

We will only process your data with your express consent. It will not be disclosed to anybody outside our Group. Nor will there be any cross-referencing of such data with data that may be collected by other components of our website.

6. Personal Data in the Online Repair Form

The service form makes it possible for you to send us your repair enquiry online. The data entered by you are sent by email to a general UMAREX mailbox.

The personal data you have provided on the service form are only used for the intended purpose of the processing of your repair or calibration enquiry. These include:

Device-specific repair history

Since the processing of your personal data is necessary in order to handle your enquiry and to fulfil the contract, e.g. for a shipment of goods or for pre-contractual measures in case of enquiries, these data are processed on the legal basis of Art. 6 I lit. b GDPR.

7. Application

You can submit your application by post or email (This email address is being protected from spambots. You need JavaScript enabled to view it.). If you apply with us, we will process the information we receive in the context of the application process, e. g. through a letter of application, a CV, certificates, or other forms of contact. What we need to know, other than your contact data, is above all information on your training, your qualification, your work experience, and your skills. We will only judge you based on your suitability for the position in question so there is no need to include a photo.

Initially, your data will only be used for the application procedure and to decide whether or not we will offer you a position. The legal basis for this data to be processed is section 26, para. 1 of the German Federal Data Protection Act (BDSG). If your application is successful, your personal data will become part of your personnel file. All applications will remain with us for up to six months after conclusion of the selection process and will then be irretrievably deleted or fully returned to you. In case your application has aroused our interest although we cannot offer you a position at the time of application, we will request your express permission to retain your application data for a longer period to have it available for future job postings.

Your personal data will only be collected or processed by personnel responsible for handling your application. If you apply for a position with one of our group companies, your data will be forwarded to this company for this purpose.

8. Use of cookies

Our website uses cookies. These are small text files that make it possible to store specific information related to the user on the user‘s terminal device while using the website.

We use the option “- extended data protection mode -“ provided by YouTube.

When you access a page that has an embedded video, it connects to the YouTube servers and displays the content on the website by notifying your browser.

According to YouTube, only data is transmitted to the YouTube server in “- extended privacy mode -“ when you watch the video. If you are logged in to YouTube at the same time, this information will be assigned to your YouTube account. You can prevent this by logging out of your member account before visiting our website.

Our website includes videos on interfaces to the services of Cliplister GmbH, Schauenburgerstraße 116, 24114 Kiel (“Cliplister”), so that we can present our current products to you.

We connect to Cliplister via web interfaces to give you the content in the best possible form when you visit our website. We create online presences within social networks to communicate with users and interested people who are active in those networks and to be able to inform them about us.

The providers of these services may process user data outside the European Union. This may result in user risks, as, for example, it may be difficult to enforce user rights.

The social media site you have visited allows you to react to our posts, comment them, create your own user post, or send us private messages with personal concerns. We will use any data you surrender in this context that may be available to us (e. g. username, images, possibly interests, contact data) only for the purpose of customer communication and communication catering to special interests. 15. Legal basis for processing

Insofar as we obtain consent for certain processing operations, such consent is based on Art. 6 I lit. a GDPR. If the processing of personal data is necessary for the performance of a contract, for example for a shipment of goods or for pre-contractual measures, e.g. for inquiries, such processing is based on Art. 6 I lit. b GDPR. If our company is subject to a legal obligation through which the processing of personal data is required, for example in order to fulfil tax obligations, such processing is based on Art. 6 I lit. c GDPR. If any processing of personal data is not based on any of the above-mentioned legal bases, we shall process data in order to safeguard a legitimate interest of our company (improvement in the conduct of business activity) according to Art. 6 I lit. f GDPR.  We always make sure that no legitimate interest of the person concerned which outweighs our legitimate interest is precluded.

16. Duration for which the personal data are stored

The criterion for the duration of storage of personal data is the respective statutory retention period. At the end of the period, the corresponding data is routinely deleted, provided that it is no longer required for the fulfilment or initiation of the contract.

If you send us an email through the contact form, your emails will be received by the corresponding mailboxes and will be archived there for an unlimited period.

We will use your data submitted for the newsletter until revoked by you so that we can inform you about news on an ongoing basis.

Your data stored in the context of your use of our online presences will be deleted - to the extent we can - upon discontinuation of the site.

17. Rights of Data Subjects

In accordance with Art 15 of the GDPR you have the right to receive information about the data stored by us and the purpose of storage at any time. You can revoke your consent to store or use your personal data in writing at any time. You also have the right to object to processing for legitimate reason under Art. 21 of the GDPR. In addition to revocation, you also have the right to demand rectification (Art. 16 GDPR) or restriction of processing (Art. 18 GDPR) or blocking or erasure of your data (Art. 17 GDPR).

You have the right to lodge a complaint with the competent supervisory authority (for North-Rhine Westphalia: The State Commissioner for Data Protection and Freedom of Information of North-Rhine Westphalia in Dusseldorf) in accordance with Art. 77 GDPR.
